Commercial Disputes

While our attorneys are skilled and effective in the courtroom, we counsel our clients on understanding the alternatives to, and the risks and costs of litigation, including financial and other business-related risks. We represent clients in all aspects of resolving disputes, including investigations and fact findings; electronic document and all other forms of discovery; risk analysis; crisis management and public relations; and mediations, arbitrations, and all other forms of alternative dispute resolution. Often careful investigation coupled with a balanced analysis of risk can point to a resolution that helps a client achieve its objectives short of litigation.

When litigation is unavoidable, however, our attorneys zealously and tenaciously represent our clients' interests. Our litigation experience includes, among other, several major First Amendment cases involving the constitutionality of federal commodity checkoff laws; major real estate cases; cases involving protection of intellectual property under federal and state statutory and common law principles; employment disputes, including the defense and prosecution of claims alleging wrongful termination, claims under the Americans with Disabilities Act of 1990, Title VII of the Civil Rights Act, and the Age Discrimination in Employment Act; business torts, including unfair competition, misappropriation of trade secrets, defamation; and invasion of privacy. We have also represented clients in proceedings in federal and District of Columbia administrative agencies, including the Surface Transportation Board; the Alcoholic Beverage Control Board; the District of Columbia Department and Regulatory Affairs; and the Office of Employee Appeals.

A number of our litigators have been involved in landmark cases, including a successful prosecution of a trademark infringement case against a major food service company in American Angus Association v. Sysco Corp., 829 F.Supp. 807 (W.D.N.C. 1992). We have achieved success for our clients in all aspects of representation, including multi-million dollar jury and non-jury trials, mediation, arbitration and complex settlements. When necessary, we have pursued appeals for our clients in federal and state courts.
